These Terms of Service ("Terms") govern your use of the SparkPulse iOS app, sparkpulse.ca website, and any related services (together, the "Service"). The Service is operated by 2800977 Alberta Inc. ("we," "us," "our"), a corporation registered in Alberta, Canada.
By creating an account, entering an access code, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. Users between 13 and the age of majority in their region must have a parent or guardian's permission. The Service is not designed for, or directed at, children under 13.
2. Your account and access
Some features require an access code or account. You are responsible for keeping your access credentials confidential. Notify us at support@sparkpulse.ca if you believe your account has been compromised.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from the app
- Use the Service to violate any law or regulation
- Resell, sublicense, or distribute access to the Service
- Interfere with or disrupt the Service or its underlying infrastructure
- Use the Service to harass, harm, or impersonate others
- Submit false, misleading, or unauthorized content
4. Health and medical disclaimer
SparkPulse is a tracking, education, and journaling tool. It is not a medical device, diagnostic tool, or substitute for advice from a licensed healthcare professional. Information provided through the Service — including nutrition estimates, activity recommendations, and explainers in the Evidence Hub — is for general informational purposes only.
If you have a medical condition, are pregnant or breastfeeding, are recovering from surgery, take prescription medication, or have any concern about your health, consult a licensed healthcare professional before making changes based on the Service.
Nutrition data is sourced from Health Canada's Canadian Nutrient File (CNF), USDA FoodData Central, Open Food Facts, and AI-based image analysis. Values may differ from product labels. Use your best judgment.
5. Subscriptions and purchases
Optional paid features may be offered from time to time. Where available:
- iOS in-app purchases — processed through Apple's App Store and managed in your Apple ID account settings. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in iOS Settings → [your name] → Subscriptions.
All prices are shown in your local App Store currency. We may change pricing for future purchases at any time; existing subscriptions will continue at their original rate until cancellation or renewal.
Refunds for App Store purchases are handled by Apple in accordance with Apple's policies. Contact support@sparkpulse.ca for any other questions.
6. Intellectual property
The SparkPulse name, logo, app, website, and original content are the property of 2800977 Alberta Inc. and are protected by copyright and trademark law. The Evidence Hub content is provided for personal, non-commercial use. You may not reproduce, republish, or distribute it without written permission.
You retain ownership of the content you create in your journal (food logs, progress photos, notes). By using the Service you grant us a limited licence to store and process that content solely to provide the Service to you.
7. Third-party services
The Service uses third-party providers (RevenueCat, Passio Nutrition AI, Google Analytics, Apple Health). Their use of your data is governed by their respective privacy policies. See our Privacy Policy for details.
8. Termination
You may stop using the Service at any time by uninstalling the app and clearing local data. We may suspend or terminate access if you breach these Terms. On termination, sections 4, 6, 9, 10, and 11 survive.
9. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that data will be accurate in every case. Activity rings, nutrient estimates, and AI photo analysis are approximations.
10. Limitation of liability
To the maximum extent permitted by Alberta and Canadian law, our total aggregate liability arising from or related to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim, or CAD $100, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there. Disputes will be resolved in the courts of Alberta. If any provision is found unenforceable, the remainder of these Terms remain in force.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date and, for significant changes, announced in the app. Continued use after changes means you accept the updated Terms.
